I am stoked about this, but thinking about it I have rock band preordered , and am still playing thru orange box, (done with portal, ep1&2) I am gonna pick up almost anything i can when i get the cash, with a week until rock band and $5 in my pocket i think I will wait a month or so until i get this. I do wanna know how it is though!!

word to the wise, anyone in nyc might want to actually go to the store instead of calling because alot of the people that work at kmart are idiots, i just to work there and people in electronics dont kno wat their doin or where to look properly, its funny but true. so head out and check i would but im lazy

Well you should of checked the KMart in Bridgeton, MO on St. Charles Rock Rd. (another suburb of St. Louis, second of 3 KMarts in the St. Louis area.) They had 3 copies, I paid for 3 copies, but walked out with zero copies after being ****blocked; long story ...

No one could go by this store for me today and since I needed to visit a nearby friend for some money he had for me from a monitor of mine he had sold to a co-worker, I decide to give it the old college try. Mind you this is the first time I'd ever walked into this store, and I already had the LE ordered off of Gamestop.com. I decided before I left if they had it, I was cancelling my pre-order as 10 days early is better for me than the stuff in the LE.

I find electronics in the back of the store and I proceed to look for the gamecase (after I tell a customer I don't work there as apparently they wear red there and I had a red Cardinals jacket on.) I scan the gamecase and it's not visible. I then see that under each section of the game case there is a rubbermaid like container with games in each of them.

I decide to get on my knees and look at these and as I bend my neck sideways to see the spine of 3 games on top of one of these Rubbermaid containers underneath the 360 games, I see the glorious Bioware Corp. logo.

I almost leap for joy right there on the spot as I spend two minutes trying to find the call button to get someone in electronics. When the kid comes out there was a couple ahead of me and I let them go first but they just had a quick question and then the guy comes to me. I advise him I would like to purchase a 360 game.

This is where my fate was probably sealed. I show him where Mass Effect is. He goes "no way; we've been looking for this as people have been calling about it." I stop him and ask if I can have more than 1. He asks how many, I ask if I could have all 3 and he's like sure.

We proceed to the register as he scans the games. Apparently no prompt comes up about not to sell them yet as I heard beeps and got a little worried, but apparently those were the beeps because of the Mature rating prompt. He gives me my total, I scan my credit card in the machine, then the register spits out the receipts and he hands me my copy to sign.

I am signing the credit card slip, he has rung the sale through the register and is putting my games are receipt in my bag and is about to hand me my bag when his co-worker, Jonathan, comes up and asks him what he's doing.

The first guy is telling him I'm buying Mass Effect as I found it under the shelf. Jonathan tells the guy you can't sell it to me, first guy asks why not, Jonathan says it's too early. First guy no says it's ok, Jonathan points to the top sticker and says it's not 11-20 yet and then tells me, "I'm sorry sir we can't sell this to you," and yanks the games and receipt from the first guy before he can hand it to me.

Mind you I have signed the credit card receipt and the transaction is already run through the register, I just don't have physical possession of the product. I ask why not, even though I know why not, and Jonathan says, "All 3 of us will be thrown in jail if you leave the store with those games because it's against the law." I advise him there is no such law and he reitterates that this is illegal and all three of us will go to jail if I get these games.

I advise again that there is no local, state, or federal law about selling items before a street date. I advise him there may be an agreement between KMart and the distributor (in this case Microsoft) but really that wasn't my problem as I had paid legal tender for the games and the transaction had completed and it was too late to take it back. Jonathan backs off now saying well we'll be in big trouble for this and I can't let you have the games. I advise that's not acceptable as it's too late to be worried about street dates and I demand to speak with a manager.

An asst. manager by the name of Steve comes up, who I find out later is the only manager apparently on duty at the time (around 5 p.m. central.) Steve reitterates the stuff about street dates I already know. I advise him that's not really my problem as I have paid for the games and that tens of other KMarts across the country have no problem breaking the street date for this game and if I had internet access I could give him the cities of each KMart that's done it so far.

He then says that it's not their problem what other stores do and they face repercussions from the distributor. I advise again the transaction is already complete and I want my property I paid legal tender for. Steve then asks, "Where did you find out about this street date," and Jonathan shows him the top sticker. Steve then says, "I don't care what you tell me sir, this sticker says you can't have this game. These gentlemen will walk you to customer service and give you a refund." I demand to have the district manager's name, phone number, and email address as I've have my property unjustly confiscated and been threatened with jailtime by one of his associates. He tells me that info will be at the customer service desk.

Steve retreats to the back room with the 3 copies of Mass Effect and I am escorted to customer service. When we get there Jonathan tells the girl up front, "Don't ask any questions just give this guy a full refund," and hands her my original receipt." I then advise I need the district manager's name, phone number, and email address. She just points up to the generic sign above her that lists the toll free number. I say that's not good enough and I want something else. She then calls for the MoD to come up.

In comes Steve again and the customer service desk rep tells him the info I want and he says that's all I can give you. He wants to know why I want the district manager's phone number as they're giving me a full refund. I advise because I had my property I legally paid for unjustly taken from me and that (pointing at Jonathan) told me I could be arrested for buying a game too soon and that is nowhere near the truth. Jonathan starts to make a slight protest and Steve puts up a hand for Jonathan to be quiet and tells him to go back now, and Jonathan complies after slamming the pen that was in shirt pocket on the desk.

Steve apologizes and says the toll free number is the best they can do. I advise that's pretty pathetic that you can't give my anything other than a generic phone number as where I work if you want someone higher than the store manager, I ask do you want the district manager or the corporate number (I currently work for the Oreck stores in St. Louis.) I ask for a pen and he gives me one so I can write down Steve and Jonathan's names and the toll free KMart number. I then advise him that's why no one shops at this chain, thanks for nothing as I storm out after laying his pen gently on the desk. He wishes me a good day as I storm out.

Now mind you 1 copy of the game was for myself, one of the other copies was going to be offered first come, first serve to my STL XBox Live friends or a member of CAG, and the other was going to be for profit on EBay. Now if the original guy had realized that it wasn't 11-20 yet and told me he couldn't sell me the game before the transaction completed, I would of hemed and hawed and did my best puppy eyes and asked everybody else is doing it, couldn't you do it too and been shot down, I would be agitated but cool about it.

But for the transaction to complete and for someone else to walk over and take away product I legally paid for, then threaten me by saying I could go to jail for buying it if I left the store with it, then I have a MAJOR problem. I'm calling KMart tomorrow, or Monday (if they're open,) or Tuesday and seeing what I can get as compensation for what I feel is illegal seizure of my property and terroristic threatening.

If I can get 1-3 copies of the game for free, or a gift card equal to the amount of my original purchase, I think that would be fair compensation for illegal seizure of my property and terroristic threatening by an employee of the store. FYI I have my original purchase receipt, the two bonus receipts it printed out ($15 off a $25 purchase from Nov. 30 to Dec. 2 and $50 off a Sears Outlet Appliance purchase of $200 or more) and my receipt from the return on my credit card.
 
That's wild. Who would of thought they'd give you so much shit over buying games?

I've never heard of a store confiscating something from you after you've already paid for it.. ridiculous.
 
That really sucks! After the transaction was complete, the problem is on their hands. They just did that to you in order to save their jobs, probably.

You should have not accepted the refund.

You should have then proceeded to the nearest police station or phoned for the police to arrive on site and you should have accused the manager (or whoever confiscated the games) of stealing your property. You have the receipt in your hand and he had the merchandise either in his office or somewhere in the back.

By calling the police, not only would the manager might simply comply and give you your product once he had figured it out, but since there would be a police report filed on his store, he might be more willing to cooperate in order to avoid that (or else the district manager would have been notified anyway). Also you can always threaten to call your lawyer even if you don't have one. That's generally pretty effective.

Feel really bad for you though. Good luck in getting some just compensation.

Problem was I never had the games in my possession and didn't get the receipt until after the refund. It was either refund, or I donate $194 and change to K-Mart's bottom line. Jonathan (the douchebag employee,) yanked them out of the first guy's hand before he could hand them to me. If I had the games and receipt in my possession, Brian Urlacher couldn't have stopped me from getting out of that store (I'm from southern Illinois originally and I hate the Rams.)

I should of thought about calling the police but I was so furious I wasn't seeing straight. I've sent my story to the Consumerist and I may go to the local police station tomorrow or Tuesday to file a report.

The Greensboro store (there's only 1) is the definition of ghetto :lol: its dilapidated to hell, but they always have the games I look for because no one bothers with it. I scored there on the clearance thing a few weeks ago and now this.

Did you read my post? 1 copy was going to be mine, 1 copy was going to any of my XBox Live friends from St. Louis or an STL member of CAG/nice member, and 1 was for EBay, and even then if I personally knew someone who really wanted it, I would of been fine not taking any profit and letting two additional people get the game early as I did.

Getting only 1 copy was an option but I decided I wanted as many people as possible to play the game, as I've been waiting for this game for 1-2 years, as have many people I personally know.
 
Sorry to hear that MSU. I think my local KMart is run by alot of old ladies, lol, so if I somehow found a copy I'd probally have better luck than you, but my local KMart sells crap.

Im not going to dismay your story, but I don't know how I would've handled it either. Luckily Tameka my Kmart employee isnt very keen on video games so it was no problem, but because you didnt have them in your possession, outside of physicality and/or calling the cops, what else can you do? The manager would've explained to the cop the situation most likely and you would be in the same boat.

You just ran into a dipshit clerk. They were trying to save their own asses.

I'd go with something like "threatened to have me arrested falsely, as using the term "terroristic" just kills the credibility here. No one was using terrorism on you.

They fucked up. Thats what it is. There was not much of anything you could do once that idiot clerk snatched them and stormed off. Had you called the cops, they would've not been able to get you your games back most likely, because the manager would've pulled the street day garbage. The fact that you didnt have the games in hand, they gave you a refund immediately, would all have been positives to their side. I'd still suggest calling Kmart corporate and at least try to get that Jonathan kid canned :lol:

You should have called the cops the second they would not give you your rightfully paid for games. I guarantee if you had called the police in front of the MOD then he would have buckled and given in. I also would have refused the refund. They cannot force you to take a refund.

A terroristic threat is anything that makes you fear for your personal health, safety, or freedom. This guy just got shafted, what the store did is illegal and he does have legal recourse, but the point the guy made a couple of posts up is valid, he should not have given them his card to charge the refund back and refused to leave until he had the games that he purchased back in his hand.

This store violated his rights as a consumer on a state and federal level, check out the Fair Trade Act on the Federal Trade Commission website for more info. It will give you links to local and state consumer protection laws as well. Fight The Man!
 
Sad thing is if you did get the law involved and KMart did end up giving you your games, the manager and employee that treated you like crap would still more than likely have there jobs, while the one that rang you up would lose his.

Just the way society works.
 
DO NOT CALL KMART IF YOU ARE PLANNING TO TRY AND GET THIS

I suggest just go down there and look. I called a friend of mine a little earlier tonight back home in CA, and the douchebag called KMart. Or course, they had it (he lives in Marin County) but when he called to confirm its availability -- the clerk said "yes we have it.... wait we cannot sell this until the 20th, Im sorry".

I don't know if they were on the shelves already, but a word to the wise is just go down there, if you get a clerk on the phone with any sort of brain you may screw yourself and others out of it.

First employee gives me total, I swipe card in self-swap machine at the register. Machine asks me for my zip code. I input zip code. Register receipts print out. First employee hands me the merchant receipt to sign. I sign the receipt and push it toward the employee as he's about to bag and hand me my merchandise when the second guy stops him.
 
That's a really interesting story. It's really their fault for putting it out on the shelves. If I was in that situation...I don't know. Part of me wants to make a scene and demand what I purchased.

on the order status it says "estimated arrival: before or on november 20", but it usually takes about 2 days for stuff to get to me from toys r us. unfortunately, there's a holiday, so that'll probably add another day to it.

Isn't it that once the cashieer prints the receipt, the product that you purchased is legally yours wether you have ahold of it yet or not? If only you had remembered to make the cops but in, I think you wouldof then had the three no problem. The employee was probably scared shitless of getting fired or something if the store found out I bet, but that still doesn't justify what he did.

You could try again when they open up this Sunday morning as the asshole probably isn't working. I had gone there earlier in the morning yesterday and checked the tubs with no luck so they probably put it in between when I went there and you went there. I may of been lucky if it was there as there was an old lady working the register at the time but there were also a young male and female employee nearby that may of butted in. Never liked that Kmart and it's not popular either when compared to target just further down the road (Hell anything in that small center there isn't popular). Regardless, I'm not going to drive back there as I'm not impatient enough and I have plenty to keep me occupied until the official release.

That means your order has not shipped yet. At the very best, the pickup order has been sent to the delivery service and that's it. Especially given the fact that it is the weekend and the only delivery service that picks up is FedEx and DHL and that is by using FedEx/DHL Same-Day, which no online retailers use that I know of since it is very expensive and has a weight limit. Everything else takes at least 1 business day. So unless you have a tracking number that shows "In Transit", your order is not on it's way yet.

The funny thing is that the 2 guys that are villianized are the ones that did their job and actually was thinking a little bit.

You knew the product shouldn't have been released yet. I can't understand how you can pretend to be so surprised in that they took the product back knowing that. And I hope you're just acting upset in your 'treatment'. They didn't mistreat you. Whether you agree with what their decision on the game was or not, you're being a complete b*tch about the whole thing. If you're really still upset..just remember that they work @ KMart. Punishment is being served on a daily basis for them just by waking up and going to work.
 
No go, went back at opening today and had the employee there search for it and found nothing.

Ah well, at least I have other games to keep me busy until it officially comes out.

Doing your job is not pulling the game out of the case, reading the release date sticker at the top of the game, and by all means, not ringing the game up. I'd be ticked if I tried to buy it, he swiped my credit card and as I was signing the slip, he told me I couldn't buy it. Only for the simple fact that now $194 is tied up in pending charges limbo. The transaction was pretty much complete, yanking it at that point is wrong.

Nobody told these people they had to work at KMart. They chose to work there. So, I don't see how their job is punishment.

Didn't see any from the 2 Kmarts in the Cleveland, OH area. But that's ok, I'm cool with waiting.

Granted this was yesterday, but I called my local k-mart, and asked them to hold a copy no issues at all.
 
It's funny because the Xenia, Ohio Kmart is the worst department store ever. It's dirty, trashy, gets no business, and the employees are pricks. I haven't stepped foot in there in years. They never participate in the clearances, they have no prices on anything, and they never update their prices to reflect current retail value. Once I heard Mass Effect could be there, though, I ran into that store like a running back headin' toward the endzone. This is the only time I'm thankful that the Xenia, Ohio Kmart still exists, and how it still exists is beyond me.

Anyways, I have impressions of the game on my 1up blog, if anybody is interested. If you also use 1up, throw me a friend's request while you're at it.
