People have a right to get new games if they're shelling out money to Newegg. No one is calling for a protest or to call up the AG, I was just merely pointing out that if Newegg is selling used shit as new, they've got to state its used, defeating this logic by a few posters of "oh well they never said it was new."

So if Newegg screws you with a used game, return the game and get your money back if the product is not of a quality you're willing to accept.
 
I love NewEgg, but resealing games is a no-no to me. How Gamestop is able to get away with the fraud that is apparent in every single one of their stores is beyond me. But thankfully I have never received a resealed game from Newegg. I did receive the wrong version once but they told me to keep it instead of sending it back. It was a PC version of Shadowrun which I couldn't play anyway, but it was nice of them to just say "feck it". With that experience I'd say their customer support is great.

Keep the deals coming! I beat 50 Cent and Kane and Lynch over the weekend, so I'm hoping to see more $10 or under deals shortly.

Again, you missed the point.

At least one person kept going on about how the website didn't specify whether the games were used or new, so people don't have any right to complain as long as we got a working version.

I cited an applicable law that basically says if you're going to advertise something and its a used product, it must be stated as such.

Therefore it doesn't matter that the website didn't specify it was NEW, rather, the fact they didn't specify it was Used/Refurbished/Previously Opened/Etc. DOES matter because people were under the impression they were purchasing a NEW game. That's the entire point I was trying to make, and nothing more.

So people could and should return their re-shrinkwrapped games and if they want to let the CA AG know Newegg isn't accepting responsibility for selling used games and new - then fine, but I'm not derailing this thread calling for that and no one else is either.

Its like you saw legal terms so all of a sudden you think someone is "rah-rahing" calling for a class action lawsuit and for the CEO of Newegg to be hung in the public square when in fact no one is doing that.

Years back I preordered a game at a GS. When I went to pick up my game, they tried to pass me a gutted copy saying it is brand new. They fucking gutted my preorder copy. Needless to say, I took my money back.

Yes! I paid $30 for it and it was worth every penny. The character models are a little bit too chibi for me but the battle system and animation is classic turn-based JRPG goodness. I also love how you can search practically every single nook and cranny for items and find something. The magic vs. robots theme was great, too and even the mini-games were fun. So, uh, yeah for $10 I'd say it's definitely worth it.

So I dont see why anyone is uptight about things. Those who felt they were 'wronged' were made whole and then some.

@kodave: If you want to believe that the location of incorporation is somehow irrelevant to where a company does business, be my guest. Though I'd encourage you to check out your credit card agreements a little more closely.

Credit card agreements have no relevance on this issue. If the principal place of business is California and they are shipping out of California, the consumer protection laws of California apply. I'm not sure why this debate is continuing. New Egg seems willing to comply with the law, so if you get a used game, just call up and make them replace it. End of story.

I'd say the story is really weak for a Sakahuchi game, but maybe a bit better than average by Japanese RPG standards. Both gameplay and (lack) of story remind me of Final Fantasy 5. It's good, but not as his post 5 stuff.

EDIT: Lost Odyssey is a lot better, but they're both two of the best Japanese RPGs this generation...actually they don't have much competition, but still probably the two best.

I never said that, but I'll reply to you anyway.

I assume you're referencing provisions in various agreements including credit card contracts that say if you sue the credit card company, a certain state's law applies regardless of the jurisdiction of the court. "Choice of law" provisions are generally valid. You can literally pick a multitude of states and that has nothing to do with the state of incorporation - but it could most certainly be the same state as the incorporation state laws that apply if thats what the company picks.

Again, I merely stated that the state of incorporation doesn't make a company immune to the business laws in the states in which it practices. Newegg is most certainly subject to California laws and possibly the laws of other states, and being a Delaware corporation has nothing to do with that.

So yes, if I sue Newegg on a contract principle over the quality of the products received, its entirely possible Montana state law applies if I somehow agreed to that by purchasing a product from Newegg (not sure if this would actually be upheld though).

But if the CA attorney general says "You have business locations here and sold used products as new to residents of CA and violated this law and this law" Newegg is certainly subject to that, regardless of what state they're incorporated in or what choice of law provisions apply between them and consumers.

You can't escape the law just by saying "Oh I incorporated in butt-fuck-Egypt, fuck off."

The only thing I can think of that would be childish is that the main cast is comprised of children. Otherwise, it's a typical save the world from some powerful villian who wants to destroy it just because he can. But weak story aside, you should still pick it up because you'll enjoy it if you like turn-based JRPGs. I don't even think there was that much grinding necessary so already it's got a huge point in its favor.

I don't want to get muddled into this, but you both are also breaching on a very gray area of the law, which is whether doing Internet business opens you up to jurisdiction (and liability) in all 50 states. The law remains rather divided on this topic (I don't think the Supreme Court has addressed this).

There's no set threshold right now that says that NewEgg would necessarily be subject to CA state statutes (under the presumption that it has no B&M stores there). Now Amazon no doubt would probably be subject to all states (but that could also be because it runs national ads and even advertises in national papers). NewEgg, on the other hand, may or may not be, depending on exactly how much revenue/sales they're pulling from CA. I mean, NewEgg isn't exactly a national company; it's more regional. If NewEgg is a co. on the East Coast and that's primarily where it does its business, then the fact that it makes a few hundred sales into CA may not be enough to haul it into CA courts.

Just having an Internet store open for business everywhere shouldn't be dispositive on the jurisdiction issue (though I'm sure you can find a circuit case that gets close -- there's one we read in CivPro where the court held a small site subject to state laws merely on the fact that it got a few hundred hits from visitors of that state -- now that was an old case and I think a good attorney can put that into context now). I have no idea what the law or test here is, but I would suspect courts expect other circumstantial and direct evidence that shows that NewEgg is doing business in CA or any other state for that matter to really make it liable under its corp. laws.

Just my two cents.

Yea, it was in my cart earlier for $19 when I got home. I guess an hour or so later and the price dropped back down again because maybe they ordered more? Idk, lol.
 
I think I still have a game or two unfinished from last Christmas, but I just couldn't fricking resist Resistance PSP for 10 bucks. $20 is a good deal; $15 is a great deal, but I couldn't even think about not buying it for a tenner.

Good call. It's one of the better PSP games and a great buy at 10. I think I paid 15 a while back thanks to CAG and certainly didn't regret it.
