I would like to think the bankruptcy judge would be more civil than that. That and could the judge's decision be appealed?
Oh, he might use a different euphemism but the intent would be the same. And no, no sane state would allow an appeal on such. This isn't a sentence on a convict. This is contract law and the entity that singed the contract has succumbed to the longterm vampiric effects of the other signer. You cannot have your cake and eat it, too.
This has now been established to cover municipalities as well. Whole cities have gone into bankruptcy and the judges told the public employee unions they were out of luck and none of contracts had any power going forward.
The state of California is currently in a death spiral, refusing to give up any of its grotesque spending agenda, including completely unviable commitments to public employee benefit and retirement plans, and believing the citizenry will accept any growth in taxes the legislature seeks to impose.
This is why so many of us are voting NO across the board in the May 19 ballot. We want to see history made with a state level bankruptcy rather than let these assholes keep dragging us down further. We'll be treading completely new ground here and I like it.
