From personal experience, if somebody sells you something from Paypal that is digital and can not be traced through federal mail, you can dispute the money you sent to him and they will place a hold on it until both of you respond. To sum it up, gift or not, call 1-402-935-2050 and explain the "gift" was to purchase an item from an individual not utilizing eBay and that the item was not delivered. They will put a claim on the money until you both respond with what happened. If he delivers the game you have the option to tell Paypal that so he can receive his money. That's your purgative.

You used Paypal to give him money as a "gift" in order to purchase something. You apparently selected "gift" so no fees would be collected by Paypal for using their service.

Paypal does not have buyer protection over digital delivery. Also adding in the fact that you circumvented their service to use it without paying for it (buying something with a 'gift' payment) and I think you end up with Paypal having no real desire to help you. Perhaps I am wrong, but I doubt it.

You also do not have the person's physical address, just an email. So you can't really go the mail fraud/police route because A) Nothing was shipped physically (U.S. Mail fraud) and you have no physical address (police involvement for theft).

If you used a credit card just dispute the sale. You might be able to get your money back that way.

my brother Kevin is the one who is supposed to send you the code. I thought he took care of it last week.
He asked if he could use my paypal account and I agreed.
I apologize for the delay, I will contact him today and make sure he sends it.
Please, I don't want to have problems with my paypal account.

So his brother was on his paypal AND CAG account? I doubt it. He's trying to milk it out. Do what Bronson said. Wait until everything is good, and I'd ask to be reimbursed half before I'd cancel it.

Everyone else gave great advice. Take things as far as you can and don't even think about taking a step back or dropping things until things are made right. You've had enough empty promises thrown your way.
 
Got another email
I'm proccesing the refund, my balance on paypal was $0 so I had to transfer funds from my bank account. Usually it takes 2 days, as soon as the funds are on paypal I will refund your money back.

man, i cant stand scammers! great job putting pressure on him. now he may think twice abt scamming here, at least (& u MAY get ur money returned). be sure & put negative feedback regardless - so others can see before he can take advantage of them.

Yes! sorry again and btw, I'm very mad with my little brother...he's 17 but he needs to be responsible. He's not going to survive out there in the world acting like this.

Hmm.. there is a guy that lives in my region named Sebastian and I think that might be his email (seen it through craigslist) and he has been screwing people over with 'fixing' their xbox 360's for $50 and they don't end up actually being fixed.. might not be the same guy, but it looks VERY familiar..

either way, i hope you get your money back and then some

Lol I find it's funny that he said his "little" brother is 17 but from his emails he sounds a lot younger than 17 to me. What a pathetic excuse to get away. He is probably trying to get a 12month code on sale somewhere for you or just trying to sweet talk you to cancel the investigation. But like others said leave it there till you get your working code or money back.
 
wow after reading 4 pages of this, i really hope you do get you money back. im fully interested too to see how it comes out, and I too hope for a good outcome.

Leave proper feedback, and by proper I mean negative. Don't feel bad for leaving negative feedback when the guys deserves it. You can help warn other people not to deal with this guy. People pay way more attention to negative feedback than they do positive feedback. Do people a favor and red flag this asshole on CAG so he can't jerk people around again.

Hmm, I know this was a big hassle, but I think maybe this warrants a neutral. I mean, he did get his money back in the end, and it was a pain in the ass... but it's not like he didn't get his cash back.
 
agree with above statement, dont be afraid to leave a neg for a negative experience. Could save people money or time in the future.
