Question about Arrest Warrants

I recently got a job at a Casino, and during their extensive background check, they said they found something on me that I didn't know about. They told me that there is a warrant out for my arrest in Wayne County, but I've been living in Calhoun County since May (and have had a background check done on me here in June, and nothing of the nature showed up). He also mentioned that since I have such a common name (first and last), it might just be a slip-up in their computer, but it still worries me a little. I know I didn't commit any trespassing crime across the state, but for sake of example, if I had committed a crime in say the county I live in now, wouldn't the warrant be issued for this county?

This is really a question you should be asking a lawyer.

I'm not trained in law, so don't take this as 'advice,' but perhaps warrant's are issued for the locality in which the crime was committed?

I don't know if they write arrest warrants for traffic offenses (I highly doubt it except for the most egregious of offenses), so you'd have to know if you otherwise committed a real crime or not, which isn't something you should be mentioning here. Also, it could just be a name screw-up *shrug*

I absolutely did not commit any crime like that, but it just worried me a little. I was just wondering if they should have written the warrant for that county if something happened in another (which it didn't). I just wanted to know what you guys though.

The reason I ask is because I've only been in that area of the state a few times visiting family, and if it's at all possible that my name Christopher Johnson was issued a warrant even though it may have been another who committed the crime? I remember once I was pulled over and the officer took a really long time in his cruiser, and when he came back, he said that there were 6 or 7 other Chris Johnsons in the city with warrants out on them and had to do a lengthy search to make sure I wasn't one of them.

Lets make this easy....Have you ever been to Wayne County and if so did you get into trouble there? If not contact their local precinct and explain your story.

Though = in spite of the possibility that...
Thought= the action or process of thinking

I have been to Wayne county 3 or 4 times since May, but I never got in any sort of criminal activity while there.

The warrants would be issued in the county in which the crime was committed. Is this a serious crime? Did you have a traffic ticket from Wayne county that you ignored/forgot about?

Did you wake up in a pool of sweat in a random alley?

Just call the DA or other issuing authority for that area and ask what's up.

Assuming no obvious illegal activities, it's most likely either unpaid tickets that were issued in Wayne county to you or a mix up due to a common name. I would call someone over there (DA?) and get it cleared up. It may be that you have an unpaid ticket that you didn't even know you had (they put it on your car and it flew away or they mailed it to the wrong address, for example).

that is a pretty common name. I've known at least 3 people with that first and last name, so it could be a computer mix up.

Like other's have said, it may be an unpaid car ticket. Its unfortunate they might take something as simple as a parking violation so seriously, but the reality is that they do. And like other's have said, it could have blown away or got mailed to the wrong address.

I called the Wayne County Criminal Division at the 3rd Precinct PD, and they said there is no issue of any such warrants. I'm kinda glad to hear that, but I'm still curious how it popped up on my name given that I haven't been in Wayne County for 7 months, and a background check I had done 6 months ago showed up nothing.

You got lucky. It's a bad idea contacting the cops or the District Attorney. Sometimes they're overworked and cases get stale and beyond the statue of limitations. Calling them just gives them a heads up to do something about your case. If you ever have a legal question, look for your county's online database or if that's not available, contact a lawyer. Remember: Cops are not your friends.

fucking idiot...

Back in 2000 I moved to Florida on a company transfer. During the closing on a new house, the banks paperwork was held up because there was an outstanding warrant for somebody with my name from 1999 in the county I was trying to move to. Needless to say, I was not even in the state during this time nor had I ever been there visiting. I just had to sign an affidavit stating it was not me, that I lived in another state, etc... Apparently its common practice to put red flags on a name (my first and last name matched up but my middle name was completely different.). You pretty much have to prove, though without much effort, that its not you.

That was my experience, so take it for what its worth. I'd probably call an attorney and ask them what they recommend. I've done this in the past and not paid a consultation. If one wants you to come in for an appt;, just call another one. If paperwork or footwork is involved then I would expect to pay a fee.

Wow background checks just go off of your name and they don't use your SSN or Driver's License number to make sure they have the right you? You would think they would be more precise with something that could end up very serious.

Yea make sure they have the correct SSN.. If it is you, then man up and take what's coming...if it's not then either the guy is a fucktard for not researching the data properly OR someone stole your identity.

I had something similar happened to me 7 years ago. Never committed a crime/been arrested/charged, no tickets, no nothing. Applied and got a job for a school system as a tech. Everything goes fine. Second day on the job get a call from HR saying my finger prints have come back as being processed. Got interrogated by HR and I denied ever been arrested or charged or fingerprinted . Got suspended without pay for 2 weeks from the job until they cleared it up. Two weeks later get a call and they said that everything came back cleared........never got an explanation on what happened or back pay. WTF man!?!?!

Anyways good luck with your situation. The whole background check process is fucked up anyways.

Thanks. They called me Monday at about 9am and brought it up and told me that they'd contact me ASAP if there were any problems. My first day is today (and I told them this), and still no word regarding it. I guess they straightened it all out - hopefully)

Like I said in my post, I thought everything was fine too........ just because you on the job now doesn't mean that your clear...... They can still terminate/suspend you even months down the road.
