My mom just got a letter for jury duty, but she isn't a U.S. citizen shes a legal resident. She doesn't even speak english. Is she even qualified to be called up? I thought jury duty was for U.S. citizens only. What can she do to get out of it?
 
Just go to the courthouse and they'll probably dismiss her. It sucks and it's a headache but it's better than having a warrant out for her arrest.

Many counties go by DMV records instead of voter registrations and that causes many residents to get summoned and then summarily dismissed.

Where did you get your pollyanna view of prison life, from jailhouse rock?

Cynicism would have him bringing suit citing the eight amendment and losing the case.

It's a 6th Amendment claim but he'd probably still lose.

Good point thx - IANAL (obviously) and speedy trial sounds like a better reason then cruel and unusual punishment.

All I know is that what happened to this guy isn't justice, isn't right, and if it happened to any of the 'law and order' BSers on this thread they'd be screaming their damn heads off.
 
What I don't understand are those jury questionnaires they send in the mail. Every year my ma gets called for jury duty despite the fact that even though she's a naturalized citizen, she can't understand English well enough to comprehend the news, much less make a legal decision in the language.

Actually it's a due process violation. Sitting in jail for 83 days without being brought before a judge is VERY improper. Federal law dictates you be brought before a judge within 48 hours of incarceration.

Just to be clear, I agree.

I was just saying that the cynical position would be that you can't beat city hall, and that a lawsuit against the city would go nowhere. The guy deserves some justice. The bureaucrats who let this guy go through hell in jail could care less, maybe if the city gets some egg on their face the politicians will start doing their jobs and kicking some bureaucrat ass.

I need to learn quick, b/c I have to call in two weeks after two extensions.

I have no transportation, I have no money, and I have no desire to travel 13 miles to Los Angeles before 7:30 AM, wait possible the whole day, and then travel back out of LA, with the possibility it could go on for a week....or worse.
I just skipped all the pages because the Basketball game is on!
 
I missed jury duty about a month ago (late night of drinking, forgot about it).

I got a letter in the mail last week saying that I had 10 days to appear for jury duty or face up $1,500 in fines and/or 10 days in jail.

This is in CA by the way.
