XBLA games. Had them, got new xbox, lost them.

Are you serious? I've spent the last few decades thinking that. If that's not true, why did you hear it all the time, and why were there special rental editions of VHS tapes?

I think I've even seen catalog prices.

I was renting Season 5 of Smallvile on Netflix before I bought it, and those discs even look different from the Netflix discs...kind of implying they might be a special rental version.

If they don't have to use special discs, that could explain how Netflix can actually be profitable!

Bullshit. I worked for Family Video, and I've seen the prices paid for rental tapes/DVDs. It's not retail price buddy.

You paid the same price everyone else paid. The "priced for rental" model means that the tape was priced at over $100 for everyone so only rental stores would buy them (because they had to). There is no legal method to force differential pricing, and I quoted my source.
 
Ah, the good old days of having to wait for your new favorite movie to hit the shelves to actually buy after it came out 6+ months prior for rental. I still remember being pissed when Grosse Pointe Blank was rental only for about 6 months before I could buy the VHS of it...
 
So it sounds like the reason there were rental specific tapes is just so they could charge a much higher price, prior to releasing a more reasonable price?

So how come my Season 5 Smallville DVDs look different from the Netflix rental ones? Maybe just a coincidence?

Right. They know that rental places have to buy a lot of copies, especially of popular new releases. After a while they'd drop the price to consumer levels. In the 80's the cycle of theater-VHS release-home purchase was a lot longer than we're used to today.

Probably. Maybe a different edition or something. Blockbuster is big enough to commission their own pressings from studios but I doubt Netflix is.
 
Has anyone been successful with getting their points back after UPGRADING their console (or buying a new one) instead of it being repaired?

I own 42 XBLA games, but am looking to upgrade to an Elite soon. I have a launch-day-produced 360, so my reasons for wanting to upgrade are obvious (more space, HDMI). I've heard, however, that unless your console's broken, they will not refund the points under any condition.

Basically, I'm not going to waste my money on buying an Elite if I can't get full access to these 42 games, many of which my wife enjoys to play on her gamertag as well. I'm not looking to cheat the system, or anything like that...just want full access to my purchases. Has anyone had any luck with this?

really it sounds like the same boat. As long as your connected to live you should be able to re-download the game and still play it. But if you want the points I'm with enough bitching you can get them back.
 
ive mentioned this in several threads. ive swapped my 360 out at bb, they give me a reciept showing the swap. that gets faxed to ms. points get put on the live account.
didnt seem to difficult to me.
the seperate gt thing is a pain in the ass. good luck.

Unfortunately, that still doesn't solve my problem. Your solution is for playing games offline under the same gamertag you purchased them with. Currently, my wife can play these games on her gamertag - when I upgrade to the Elite, this won't be possible, which is unacceptable for me. I paid for full access to these games, and am giving Microsoft more of my money - therefore, they should be entitled to continue to give me full access.

I intend to call in when I get my Elite, tell them my old system broke and that I traded it to Gamestop to get credit towards the Elite, and request back the points to buy back the games.

I'm not even sure my solution works at all. I keep trying to get confirmation, but those threads keep getting rolled up into that worthless giant thread.

I'd buy live arcade games if I knew for a fact I'd be able to run them from any 360 as long as I moved my gamertag onto it (from a memory card or whatever).
 
I don't know if anybody has mentioned this, but I found a relatively simple solution to this problem which works on at least some systems. After receiving my replacement system, I just redownloaded all of my XBLA games from XBL right over my current ones (without first deleting them) and now I can play them offline and with non-XBL profiles.

You are mistaken. That cannot possibly work or it would defeat the entire purpose of the DRM. Why don't you go to all of your friends houses and download your games there for them to play? Usually what happens is MS gives you replacement points on a dummy account and has you rebuy the games on your replacement system. Then they're tied to that system as well.
