Xbox Owner Killed 17th Month Old Daughter Because She Knock His Xbox On The Floor

PHILADELPHIA, PA. - March 13, 2008 - -- A man who killed his 17-month-old daughter in a rage over a broken Xbox was sentenced Thursday to more than two decades in prison.

Tyrone Spellman, 27, of Philadelphia, killed Alayiah Turman with at least five blows to the head, prosecutors said. The force of the blows cracked the toddler's skull several times.

"I've been doing this 13 years, and this is one of the few cases that's ever left me at a loss for words," Assistant District Attorney James Berardinelli said. "There's never a good reason for this (murder), but this is just the pettiest of reasons."

A jury convicted Spellman of third-degree murder and child endangerment in January, and he was sentenced Thursday to the maximum 22½ to 45 years in prison.

Spellman expressed remorse for the girl's death at the hearing, but defense lawyer Bobby Hoof said afterward they would consider an appeal of the conviction.

Police believe the child's pregnant mother, Mia Turman, was napping when the child was killed. Spellman spent long hours each day playing video games, they said.

In a police statement the next day, he said he became enraged when the girl pulled down the game console and broke it. Hoof argued that the statement was coerced and that Spellman was trying to protect Mia Turman.

Alayiah was one of at least 20 children who died of abuse or neglect between 2003 and 2006 after coming to the attention of the city's Department of Human Services, according to an investigation by The Philadelphia Inquirer.

An autopsy showed that Alayiah had suffered a broken arm about two weeks before she died - an injury that city social workers did not see on two visits to the house.

The city took custody of the couple's second daughter, born after Alayiah's death.

What's terrible is that he neglected his 360 so badly, putting it where a toddler could reach it. C'mon man, that's an expensive peice of equipment! You can have more kids for free!
 
This is why I support executions. Not nearly as often as it happens but sometimes, the punishment fits the crime.

If that's not a person that deserves capital punishment, I don't know who does deserve it.

Someone explain to me how he can kill a little 17 month old baby and get only 22 1/2 to 45 years max? That is fucking ridiculous. There isn't any gray area in this situation at all.

This is one of the worst things I have read in a long time. I hope that the outrage shown exceeds that of the puppy throwing soldier in Iraq.

I don't understand why someone would kill there own baby over a console system. He could always buy another xbox. He should have got life in prison or worse if you ask me.

I don't understand why a person would kill/hurt a baby over anything. It's just a baby and doesn't know any better.

All I know is that I am around my nine month old nephew everyday and I just can't see what a baby could do to enrage a human being. Even when he cries I enjoy it. He is an absolute joy, and even though he is just my nephew, seeing his face makes any problems I have during the day better. He relieves my stress, he doesn't add to it.

He didn't plan to kill the child. So, no first degree murder.

The jury may have had the choice of second degree murder or third degree murder.

I'm curious as to why there was a jury trial.

The DA should have offered manslaughter and wrapped things up without the fuss of a trial.

Of course, Mr. Spellman may have been a complete dick.

Admittedly, I know little of the inner workings of justice, but couldn't they say he planned to kill the child once the Xbox hit the floor? Or does there have to be a certain amount of time passed?

But yeah, if the jury only had second or third to work with I guess there is nothing that can be done.
 
For not knowing alot about the inner workings of the justice system, you hit the nail on the head GuilewasNK.

For first degree murder there must be "pre-deliberation" some planning or thought, some time for reflection. This was a "depraved heart" murder, or one that occures when the passions are inflamed. Some provocation enraged him, and he had no time to cool down or ponder or reflect.

It really sounds like a crime of passion and not premeditated. Unless one could prove that he purposefully endeavored to put the 360 in a place that his daughter could damage it and provoke his lethal rage perhaps. Sooo unlikely though.

If he had gone to McDonald's for a hour to consider the child's punishment, it would have been first degree murder.

In this case, it appears to be blind, stupid rage.

Of course, child murderers don't fare well in prison. Or is it that they do farewell in prison?

Manslaughter?! Are you shitting me? This wasn't a car accident, it was a grown man savagely killing a small child. Life in prison would be justice.

You think he'll survive 20 years? I'm sure if it gets out why he's there, he'll be offed when the guards are distracted.

Let me preface this by saying that what this guy did was disgusting, and if I had my way he'd be given the death penalty. Let me also say I love my kids more than anything else in this world.

But you better believe there are times when your kids can make me you angry enough to want to hurt something. When you haven't slept for a week, your entire house smells like shit, the kids are screaming at 3am (I have two sets of twins), you have to be up at 8am for school followed by work straight after that, then come home to dirty diapers and a messy house, and you don't get to see your wife for days at a time because you work opposite shifts, you're going to get a little high strung.
 
Something very similar happened to me. One night I hooked up my PS2 in the kids room to play dvds for them. My son, who was 2 at the time, reached behind the dresser and grabbed the wires pulling the system into the floor. I admit I was very angry. I told my wife to keep him away from me for a while and I felt silly about it after I cooled down.

That isn't the dumbest I've felt losing my temper by far though. I got him a Jack Sparrow sabre on clearance in walmart for around 3 bucks. I knew it wasn't the greatest idea but I figure if he got too irate with it I could always take it and hide it. Well, I was laying on the couch with my head hanging off one day and he runs up and whacks me right across the face. I thought I had lost an eye. So I jump up and take the sabre and break it into pieces in front of him. Kinda like "Hulk smash your puny sabre!" It was bad. At least I took it out on the toy and not on him.
