No, it's the opposite; "Not for sale" notices are for retailers but it doesn't preclude individuals from selling it. It's like how mattress tags say "it is illegal to remove this tag"--that is ONLY for the retailer prior to the sale and delivery of the mattress.
Mine showed up today (using Prime), doesn't seem to have any issues with it. I'm so glad I caught this deal; this is my first PS3, and $200 was the price I had been holding out for.
Lately most recent releases have dipped down to $40 within a month or so of release, not just Portal 2. It's an okay enough deal if you absolutely need the game today, but someone who wasn't hyped enough about a game to buy it day one would probably do well to wait for the inevitable $20 price...
