Should I get this game or the ice scoop?

Because it was on display. So, the big brown box open, with the contents removed. However, each individually sealed. So, does the Disc has the "not for resale" sign?

I just got one from my Gamespot. The outer box (the big box) was open and the content was in the backroom. The guy brought everything and everything was sealed. The game itself has a regular bar code. Is that normal? Shouldn't it be "Not for resale"?

I didnt see anything about that posted, but some states can't have the Pass card. This is on Amex's FAQ page: Are there any geographical restrictions to purchasing the PASS Card? The PASS Card is not available for sale in Arkansas, New Hampshire and Vermont. The PASS Card is also not available...
