Fellow Cags I need your Help from a scamming ebay buyer, UPDATE: I LOST

I sold 6 Brand New Blu-rays to a buyer. I offered insurance as an option, but she did not buy it. Now she is claiming that she only received a broken box. Now I am very concerned because this is the first time this ever happened to me.

So, I contacted her and paypal. Paypal is telling me that I should have foreced the insurance on her and its my responsibility until the package is deliverd to the buyers house. Now I am not sure if they were expecting me to hand deliver the package.

I contacted her and I checked her feedbacks and she also tried to scam other buyers. Here is the link to the feeback she left for others.

I am still waiting for the pictures from her of the broken box. The tracking is saying that the item was received, but my question is how do I find out if the item was damaged during the shipping, does it say that.

And What else should I do? I told paypal that she gets lots of unsealed bly-rays.

You should have required insurance, but nothing you can do about it now. You could force the issue and make her return the blurays - she'd be out shipping, but she could also damage the blurays before sending to push her story. It's a tough situation. Sorry.

Wait, is she claiming the Blu-Rays were not delivered at all, or that they were damaged? First I have to say that with 5000+ feedback, 99.9% of which is positive, it's entirely possible she's telling the truth; things do get lost and damaged by USPS all the time. In this case neither of you is really at fault, and insurance was meant to protect you the seller, not the buyer. It's expected that you refund the buyer and then get reimbursed through insurance. I usually make it mandatory on orders $100+ but I've gotten screwed over in lesser instances.

Because she's being such a ***** though in assuming you were just trying to screw her over (although you're doing the same), I'd fight her on this until I lost.

Unfortunately Paypal is almost always on the side of the buyer, but in my experience their protection only covers non-delivery of an item, not the quality of the merchandise itself. i.e. If she made a claim that they were damaged it likely wouldn't be decided in her favor, but if she claimed she never received them it's up to you to prove she received them else issue a refund.

Unfortunately if she claims they weren't delivered and you can't prove fraud with signature confirmation (possibly delivery confirmation, not sure if this is sufficient evidence for Paypal as it's not foolproof), then Paypal is going to make a judgment in her favor. This is where insurance would have covered you for damage or delivery to an incorrect location by USPS.

You cant leave buyer negative so it isnt saying much.

Paypal is going to be on her side. You have to either accept return or maybe offer her a partial refund.
 
Well the feedback she's left for others has been primarily positive as well, so again it's entirely possible she's telling the truth. I doubt she's just trying to scam you. Unfortunately b/c of no insurance and Paypal biased towards the buyer you'll probably just have to come to some sort of resolution with her.
 
yea i know that she has a perfect feedback. But look the the feedbacks she left for others. This is not the first time she lost her package in mail, she orderd about 103 blu-rays from someone else and claimed the same thing.

They seem to have "packaging issues" with all their blu-rays.

2. As stated, insurance is very important for the protection of the seller. Not only does it provide a barrier of protection from scammers, it also prevents issue with the postal service who occasionally steal/lose packages and parcels.

Wow, she responds to EVERY SINGLE feedback that gets left for her. Unreal! I have a feeling this person does EBay and nothing else.
 
i was told by Ebay that if you at least offered the buyer insurance, that you are covered since they had the choice to be protected. Granted this was awhile ago but still
 
kart007k, if you have the time and will, I'd file a mail fraud report, a police report with the proper jurisdiction, and try to to report this scammer to eBay and Paypal. This is completely ridiculous. Unfortunately, substantial proof is needed. It will probably be futile to try with the hoops you'd need to jump through to prove the situation. Good luck.

Edit: I like this feedback the person left: "IGNORANT OF BASIC SHIPPING SKILLS. DVDS REEK OF SMOKE (kid's movies)RUDE PERSON" The best part is the part where she rewrapped all the titles from this lot and is selling them as brand new now. I guess she was angry because she intended to reseal and resell them like all of the stuff she has scammed from eBay.

I filed a report with eBay for you on those auctions. I would suggest as many users as possible do the same. I've also added her to my blocked bidder list just in case.

If this were 4chan, I would suggest we do all kinds of other crazy things.
 
I filed a report since it seems likely. Although, it is difficult to tell since it doesn't seem like other items she left negative feedback for were resold (looking through completed listings); unless it was a movie like The Hulk, in which case, it's popular enough that she probably sells one a week regardless. ...Then again, Swordfish and an Ocean's X collection is not something you see every day. And it's strange how every alleged negative experience she has involves being insulted. Actually, no, that's not strange at all - she writes in all caps, all the time, with too many exclamation points, and replies to every feedback, without exception. She should get smacked just for that.

Wow she's really reselling the items she claimed she never received from you. That's low, and stupid. I sent her a personal message telling her how sorry she is and reported her as selling stolen property. I listed the 4 auctions and for reason I put

They claimed in feedback they never received items #320388689942, yet here they are reselling them.

Doubt eBay will do jack. Sorry man, that's sad.

Thanx guys. Is there any legal action that we can take against this bitch? I need some help and I won't even mind filing a police report. I knew that my first instinct was right about this fucking slut.

I also got about 20 messages from her and now she does not want to provide any pictures of the damaged package. She said that paypal does not want her to show the pictures.

Don't email her about selling stolen items, I need her to keep the my blu-ray auction up, so I can prove to ebay and paypal.
 
Even if she cancels the auction there will still be a record/ghost page of it up. Showing Paypal/Ebay the auction she won and claimed she didn't get, then turning around and selling the very same items should prove something unless they're completely retarded.
 
Okay new development, I told paypal and ebay about my blu-rays on sale and paypal officially started a search against her. I also filed a report with www.ic3.gov. Now I am really going to make her life hell.

Paypal found a fraud that she did another wholesale blu-ray seller and it came to be 1600.00
 
I hope she gets caught & has her accounts banned. Criminal charges or having to pay all that back to people would be icing on the cake. Let us know what happens.

I agree with refusedchaos, you should definently give ebay a call.

Also, I bidded on a few of her auctions with no intention to pay and sent some fairly tasteless emails to her. I hope she likes Necro-Beastiality pictures and videos.
 
Well, I guess it's still possible to 'buy' back your movies and then scam her. Then when you're leaving comments, you could copy and paste some of the negative comments she's left for you or other people! Karma, sometimes you've got to give it that extra push.
 
That is truly awful. Added seller to my blocked bidders list. From one seller to another, I share your frustration.

I agree paypal has some major holes in their procedures. That being said, I've had my fair share of issues and now have a direct # for a paypal escalations specialist; pm me if you'd like it and hopefully he maybe able to assist.
