I'm glad she was charged
She's underage. She's sending out underage nude photos. This was willingly - she more than likely wasn't forced to send those out!
Then why are you glad? As you said, she's underaged. The child porn laws were created with the intent of 'protecting the children' from unwanted sexual contact up to and including rape. The fact that this is was an unforeseen loophole that circumvents the 'intent' doesn't negate the stupidity of its prosecution. Also, since she willingly distributed them herself, the 'unwanted' sexual contact is nonexistent (and don't tell me any of the 15 yr olds that she sent the pics to wouldn't want those pics... unless she's ugly).
It isn't simple.
What's the difference between the 30ish year old creep who would want to view it and the 15 year slut who wants everyone to see it????
Nothing. Which is why a lot of people feel that the sex offender laws as they currently are need to be changed to be flexible enough to prosecute actual cases of child abuse vs. normal teen stupidity. My neighbor's son (currently 26) is a registered sex offender for having sexual intercourse w/ a minor. Funny thing though. The person he 'abused', he's married to now and here's the kicker, she married him, not because he got her pregnant (he didn't), but because she actually loved the guy. When it happened, he was 18 and she was 16 and in a state where the age of consent was 17. They were making out in his car when a cop pulls by and catches them. Now, he's legally required to inform all people around him that he's a registered sex offender. Unfortunately, most people don't bother asking about the details (that's where the devil is) and immediately shut the door concluding automatically that he's a pedo.
And I feel if the people REQUESTED the photo(s), they should be charged too! Child porn laws are there for a reason. Next thing you know those photos would get posted on some myspace account with creeps viewing it and tracking this girl down!
Yeah, child porn laws
are there for a reason. This isn't it. And good luck trying to prove in court that people requested the photos. Unless there's solid documentation of the request, any lawyer worth his salt would easily get that thrown out on hearsay.
Convict her, make her pick up trash or serve food at a shelter, and do the same to anyone willingly wanting to view the photos (those who just had it sent ot them randomly should get off free....because they had no idea of it)
And that's the thing. If they convict her & make an example of her, they're going to do it as an adult. And she will also be required to be registered as a sex offender. And this will follow her
forever. This is not a DUI or a bar fight that she can laugh off when she's older. This is a stupid 15 yr old's mistake. She didn't kill anyone. She didn't rape anyone. When she's 53 and a grandmother, she'll still be required by law to inform her neighbors and they'll still come to the conclusion that she's a pedo thanks to the public shaming via the sex offender laws. And that will make life miserable for her & her family. Yes, punish her. But let the punishment fit the crime. The way it stands right now, the punishment is grossly disproportionate to the crime.
