Phantom Brave is still at 16.99 but it's out of stock ATM. I kind of hope it doesn't come in stock again just so I won't be tempted.

On another note I sent an email to newegg about my Spanish copy of Project Sylpheed and they're apparently sending me another copy and letting me keep the Spanish one. I'll be happy as long as I don't get another Spanish one...

If the disc is in great condition then why not just keep it? It was only $13 and it sells for $16 used on ebay. I havent got mine yet but long as it comes with orginal case/book/disc in great condition i think its a great deal. It doesnt say brand new on the site (usally is tho). Just open it check the disc then do a 360 game install of it to be 100% it has no defects.

Better yet, open the sucker. Play it, and complain. They'll give you a refund and let you keep it most likely. Newegg needs to learn not to do this.

You were going to play it anyways, right? I mean, I'd complain if I bought it to collect but given you intended to open and play it, that it's re-sealed is only a problem if you open and you find the game scratched or defective ...
 
no, if you buy a game that's labeled new, it should be new.

and newegg is a great company, but this isn't something that's "oh, this game is opened, oh well".

especially with the holiday season when a lot of people might buy it as a gift or something.

should def. be sealed if it's labeled new.

Ive never got a used game from newegg. They sometimes label games as refurbished tho. The game might be new just not sealed, you can tell if a 360 game is used by simply looking at the disk. Honestly even if it was labeled as new i still wouldnt care if it wasnt sealed, long is the disc/case/book are in new condition. Newegg has always done right by me as a customer and ive shopped there since 2002.

Gamestop is the ones that like to advertise as new and they hand u a beat up used copy so the get the $$.

The problem is if it's new but not factory sealed you never know what has happened to the disc (I hate to think of how much re-conditioning may have gone into it) or manual (I've bought "new" opened from GS/GC before to find the manual thumbed through and game disc slightly scratched). It just doesn't feel the same to me.

That's gamestop for you. Only time i ever shop there is if a game is coming out i want at midnight. Only then ill know ill get a NEW game.

You can always tell if a disc has been threw it by looking at it. If your really wanna be sure you can do a 360 install, it will read the entire disc if it can read it to 100% on the install then the game is fine. Honestly dont see the big deal just open the game and check the case/book/game to see if its actually new.

I hope it comes back... I really want Phantom Brave, but I'm not willing to pay $30 right now. (My SRPG backlog is already getting long)

For the record, I hate Mega Man Powered Up. That is one of the only PSP games that I actually wanted to throw the PSP. To get Protoman, I cheated and am proud of it.

This may come as a shock to you, but the majority of customers (I'm speculating about 99.9% of them) expect a product they order online to be new when it's not advertised as used or refurbished. It's asinine to expect people to be content with receiving a used or refurbished product when it wasn't advertised as such.
 
Just received my Silent Hill: Homecoming and it is factory sealed with the MS seal and original wrapping. Im not opening it tho its a xmass gift, but my copy dosent have the fake white seals like other people have reported. Looks just like a new game id get at walmart or best buy.

As for people receiving a game used when new or used isn't stated i understand people might be upset but this is a $13 purchase and by the way people explain there copy's it is just resealed by them, No one has said there game was scratched so more in likely its new games that arent factory sealed. Just Resealed by Newegg? I really dont think Newegg would send used copy's if the game was near normal price. This game sells for $16 used and if newegg sends people games that are in basicly new shape with there own seals on them then i dont see the issue. Now if it was scrathed like a gamefly disc then id see HUGE reason to complain. But its still sealed and easily givable as a gift. I usally dont like to defend certain stores but i know newegg will make it right for anyone who has issues.

It doesn't matter if the game is fifty cents, if it's advertised as new, it has to be factory sealed. That's not only the expectation, but the law in most states. You might not see the issue, but the rest of us do.

Neither are the products in any retail store where they primarily sell new items...
Newegg's items are all new unless they are specified otherwise (i.e. an open box item) which is the same as when you go to Wal-Mart. I suppose Wal-Mart could replace all of their items with used ones because it doesn't specify it's "new" on the package or label?

I got Secret Agent Clank. $8.99 with FS is too good to pass up. I'm hoping for a price drop with FS on Resistance now.

I know what you mean by this, i understand that but if it is basicly brand new with the seal missing. Its a budget game that's on sale. I got a New MS sealed copy of it today from them so i cant really give feedback on how these maybe resealed games are but only thing ive read is they have white seals on the top and bottem instead of the one MS seal. Ive seen some 360 games ive bought from stores have those white stickers plus the MS seal on them. This might not mean there used so i donno.

It could be a simple shipping mistake. Newegg does sell refurbished games (but advertise them as refurbished) and they could be getting them mixed up. Gamestop/Ebgames sale scratched and warn out cased games with 0 seals on them as NEW all the time which is bad buisness. If Newegg starts doing the same id be po'ed to.

In the United States, every single new 360 game is shipped from the manufacturer with a Microsoft seal on the case clasp. If it doesn't have the seal, it's not a new game. There is no debate about this and I would really appreciate it if you wouldn't keep posting erroneous information about opened games still being new. New Egg itself has acknowledged that these aren't new games because they keep replacing them, usually letting the buyer keep the first copy they sent as well as the replacement. It doesn't matter if the game inside is pristine, if it doesn't have the seal, it's not new. End of story.

As for it being a mistake, it might be, but it's a mistake that New Egg keeps making. As such, I would hope that they will review their inventory procedures and come up with something more effective.

I assume you're referring to the gutting of new games at GameStop, which the employees sometimes take home to play with.

Actually, many of us don't. If the seal is missing, someone removed it. It didn't ship from the factory that way. Therefore, the game isn't new. I don't understand why it's so hard for you to understand that.

I actually do fully understand why people have issues with this. Reason i donno why its a big deal here is because the game is actually cheaper here new or used then anywhere else. Gamefly had it for $9.99 for a short time but gamefly used games are exactly that extremely used. If it wasn't a good deal vs other places then id agree 100% on complaining my ass off. But only complaint ive seen so far is 1 missing sticker.

The fact that Newegg is making it right by letting people keep the unsealed ones and getting a new one is crazy good customer satisfaction. o_O

It's not crazy good satisfaction, the alternative is that they would have to pay to have the defective product shipped back to them and all the costs associated with processing the return. Gamestop online actually does the same thing on games under $20. Crazy good customer satisfaction would be New Egg correcting this problem which has been going on for months and months.

It's not an isolated case. Check the OP for additional examples including foreign language games and games being shipped with bad non-original shrinkwrap. I still buy from New Egg, but I will not accept anything that shows up on my doorstep which isn't identical to the new English US version I paid for. It's fine if you'll accept less, but the rest of us don't want to and won't.

If it wasn't the English version like i see the blue dragon errors on the OP then i would complain no doubt. But the seal sticker missing on a game that $5 cheaper then everywhere else isnt gonna make me complain. I got my Brand New copy first time on both games i order and both are sealed MS packing with same as store wrapper. So it looks like that shipping error is fixed or i got lucky. Either way used or new $12.99 with free shipping and no tax is the best ur gnna find a copy of this game in new condition.

I would and do complain when I don't get a new item when I paid for one. Many other CAGs would too. I'm sure there are also plenty of people like you that wouldn't complain.

I just got Blue Dragon and it's the English version. I'd say all of the weird problems people are having are isolated incidents and not the majority.

Basically, you can't advertise anything for sale if its used and you don't clearly state that the product is used.

I'm sure Newegg advertised these sales on their game prices somewhere, so they're breaking the law.

So yeah, people have the right to be upset about getting a used or refurbished game when it wasn't advertised as such. Its deceptive because all advertised goods are basically considered new unless specifically pointed out as used.

And this is just state law. There's many theories of contract law that would say you can't sell this shit used when everyone expects it to be new.

While they may have a California address, according to their SEC filings, Newegg is incorporated in Delaware. Cali has some very business unfriendly laws. It would be absurd for a company to incorporate there if they had the option to do so in a more friendly state like Delaware or South Dakota.

I'd bet that if you were to quote that section of Cali law to Newegg, they would assert that they are bound by Delaware law and as such the Cali law is moot.

Wrong.

The state of incorporation does not make a business immune to the laws in the states of which it actually practices business.

Furthermore there are many legal distinctions between what state a company is incorporated in, and where the company's principle place of business is.

Don't put misinformation out there. California law is certainly not "moot" for a company that does its business out of California, despite being incorporated in Delaware.

A great many companies are incorporated in Delaware because of their favorable incorporation laws, but they're not all immune to the business laws of the states in which they do business.

Maybe I should have chosen my words more carefully than calling Newegg a "California company" but that's really besides the point that the CA statute I cited applies, not to mention I'm sure just about every state in the union has similar statutes and Newegg may reach the jurisdiction of other states and federal courts as well.

You just can't re-sell used stuff as new. It's got to be marked used. That's the bottom line here.
 
Seriously? Are you guys going nuts over a re-sealed game? Just give NewEgg a e-mail and if your not happy with them don't buy from them again. If your really that batshit crazy over it then shoot your State Attorney General an e-mail, let them go crazy over this. It's not like your house was just robbed or you spent a stupid amount of money on something.
