Well, its exclusive, kind of. EA has rights to make fighting games and Activision has the rights to adventure/action games. I have a feeling that the only reason EA doesn't have all of it is because Activision signed a lengthy contract with Marvel. I honestly wouldn't hold my breath on Capcom getting the license back because Marvel wasn't too impressed with what Capcom did with the license. EA on the other hand, despite the flop, put a lot behind their attempt at a fighting game. Additionally, the deal with EA included the right for Marvel to create comic books based on EA's new characters (like the ones they created for Nemesis).
