If it's such a big deal, return it. The seller erred in not mentioning the smoke smell (or considering that the smoke smell would affect the condition of the game). He'll know better from now on.
If OP, you desire to report the guy, eBay is going to be impressed with the Seller's side of things, not yours. He contacted you in a friendly manner about feedback. You replied with an attitude, as opposed to a more appropriate reply: "I've refrained from leaving positive feedback as I'm not a smoker and I find the smell of the game offensive. How may I return this to you for a refund?" The seller has been professional through the scenario, despite his mistake BUT he is up front and willing to correct the situation.
Why you're considering reporting him is beyond my comprehension. Aside, of course, from the possibility of your wanting to whine about how your vocabulary isn't considered acceptable within eBays terms and conditions. In which case I suggest you learn to communicate maturely.
