They had the proper wording in the ads, as well as a reasonable amount of 5 dollar games... I can still go to 3 of the stores around me and find 5 dollar games. All of this is a tempest in a teapot because a few whiny children couldn't get Disgaea, Marvel vs Capcom, etc.
It will not ever bear out anything if someone tries to proclaim it bait and switch. It just doesn't live up to the requirements for a bait and switch, and showing Circuit City having intent (especially after moving thousands of units at 5 dollars) to do that would be difficult for even the best of lawyers.

15 games is not a reasonable number of games for this CC location, as it is a very busy store in a prime location. I'm not talking about legalities here; I'm just expressing my opinion. Fact is they had a corporate leak and did not respond in an expedient manner to fix the problem.
