You're the fool. Silver subscribers should be entitled to the free game, but not for the reasons you've listed.
The main, and really only reason Silver subscribers should be conpensated is the inability to play those rented games if they are on a different console.
Right now, Live works for me (*knocks on wood*), but it was down sometime in October or November. I was on my refurb console that I had just gotten back from McAllen. I could not play my vast amount of XBL titles. That sucked, but it was resolved in a day or so.
In December, Live went down again. This time, I was on my third console, one I had transfered my saves and profile to a memory card, then to the new machine. I tried to play Tiger Woods 07 with my saved profile/game. I could not, at all. This was a game that I had outright bought and had a physical copy, not something I rented. I'm not sure if anyone else has experienced this, but it for sure happened. I even double checked my save game state in the dashboard.
If XBL didn't have the absurd DRM that it does, and you didn't have to be connected to Live to use these games/saves, then I'd argue that Silver members have no leg to stand on.
