I think you're forgetting the SNES VC games. All of those would probably be a bigger concern than Xenoblade 3D or The Binding of Issac or whatever, by number alone.

I agree that they could have just included a game code and made things a lot easier, though.
I did completely forget those, and your right. I've never even considered buying a VC title, as the look like crap and are way over priced, but yeah, that would be a big issue for some as those can't go back for obvious reasons.

What games won't work with the Zelda 2ds?
Any specific "New" 3DS titles(Xenoblade 3D, Binding Of Issac), and at last count there is only a handful. And as stated above, any SNES VC titles, as they are exclusive to the "New" models as well. Outside of those games, you can play everything else on the standard 2DS.

 
Saying Nintendo is trying to "trap" customers makes them sound nefarious. I would imagine they're trying to prevent customers from suddenly having a bunch of software purchased that is no longer usable. If you call Nintendo they should be able to move your content over no problem.
