I've heard that X-Box Live bannings ban by console and not by game, but I wasn't 100% sure and wanted to verify that. All the same, I think I might pick up Halo 2 special edition for $55 brand new anyway. Probably the only game I'll buy new, but it's Halo 2 and the main reason I'm buying an X-Box.

No, they don't do anything like that. You can't identify one disc from another. The concern is when buying a used Xbox console, not a game. They don't do product keys like Windows.
