Okay another ebay situation that I need some assistance with.
A tl;dr version is at the bottom

I sold several items last week and checked that they were all delivered. The item in question was, according to USPS tracking, delivered on July 23.

I receive a message yesterday on eBay from that buyer (with a ebay ID of just numbers), saying
I put my P.O. box number in the order but it came to my home address and now it is being returned to you. My P.O. box is P.O. Box fuckfuckfuckfuck. We dont get mail to our house.
Now, in all my auctions I mention that the item will be shipped to the address that is listed with paypal no exceptions. I mailed this item to that address.

According to the tracking info, the item arrived at the post office on July 22 early in the morning. The city and zip code of the post office is the same as that of the address I mailed to.

A few hours later, the item is "forwarded" within the same city (no zip code is shown but according to Google, that city has only one zip code which is the same as the last entry).

The last entry of the tracking info has the item as delivered the next morning to the city and zip code (this city and zip code are the same one that the buyer told me as the PO Box; also this city and zip code differ from their home address').

Now why would the I get the package back if USPS has it as delivered. I'm assuming the forwarded entry means that the item did arrive at the home address but was then sent to the PO box.

This buyer might be trying to pull something.

The item I sold is a used current gen video game (listed as like new). The game's value is maybe low $30s.

Anyway, the buyer has what I would call a common last name. First name is not rare/unusual but would say it's a typical name used in fiction (maybe common in certain areas). The address associated with paypal (so called home address) is shown as confirmed.

I was going to try Google but started with Facebook. The name returned over 500 profiles so I narrowed it down to the two cities. None for the PO Box city but one hit for the "home" city.

Assuming this is the same guy:
This guy is some teenager. His default pic puts him to maybe 15-17, however two earlier ones put him maybe 13-15. All these profile pics were uploaded this year. also all were him with a phone in front of a mirror , 3 different phones and four pics from March-July (one a month except May) :bomb:. He has less than 60 "friends" and most likely joined this year, sometime in early March maybe. There is an album he posted on his wall (no photos tab or anything) which is of a car he is fixing up so I guess he around 16. The last thing on his wall is a status update on July 22. He also commented on a friend's status about 12 hours ago.

Probably sometime in late June, he changed his current city to that of the "home" address one. Also there isn't much in his "info" section. He has several R comedies under movies and "being outside" as an activity, no mention of games.

TL;DR
Buyer sends message on 27th saying game is being returned and to send to a PO Box. The tracking info shows a "Forwarded" from the mailed address' city/zip on the 22nd. On the 23rd, tracking shows delivered to city/zip that is same as the PO Box's. No return package yet.

So what should I do? I am going away next week so in the event that the game DOES come back, I can't do anything for a while. I also don't have enough in papal in the event of a "refund" (which I don't want to do).

I would assume that, regardless of it showing where it was delivered in the end, the fact that you sent it to the listed Paypal address and have proof of delivery is enough for your part.

Of course, we know what they say about assuming.

thanks for the uh comment all the way from Osaka, Japan!

I contacted the buyer and got a reply. apparently the post office said the package would be sent back to the owner (me) if the address was wrong even though USPS tracking has a "forwarded" entry before "delivered".

Easy. You don't do anything until it actually shows up in your mailbox. If/when that happens, it's up to you to mail it back out. I probably wouldn't and would just refund the buyer (minus ebay/shipping costs).

Do what Slam said. Send the person a message on ebay though letting him know that your going away for a week on vacation and that you will contact him when you get back if you should receive the package.

wow the buyer sends me a message and opens up a case with ebay.

details from eBay (with buyer's spelling and grammatical errors), dates x'd out. not sure what happens to the money since bought stuff so zero balance but then received payment from someone else.
Details the buyer provided:
Problem: The buyer has not received the item
The buyer has tried contacting you
The buyer paid on Jul xx, 2010
The buyer contacted you through eBay Messages
You have responded to the buyer
You aren't working with the buyer to solve the problem

Additional information:
"I have seen the tracking number and it shows delivered but I have not recieved it. Then the seller told me he was going on a work trip and wouldn't be back until the xxth thru the xxth of August. I have waited long enough for this item and it is starting to aggrivate me that the seller won't do anything about it."

The buyer wants:

The item

Transaction Information:
We've placed a hold on this PayPal transaction while you and the buyer work to resolve this case.
paraphrased, bolded text is exact.
I still haven't received anything. I am getting very upset with your poor cooperation. It may say it has been delivered but I have asked the post office multiple times if they have it and they dont. I want my item very very soon.
hopefully this shit is resolved (i.e. don't have to refund a cent). I also doubt the game will be returned back to me if it hasn't already by now. I really wonder if this guy actually received it

If you shipped it to his verified paypal address, I would think you should be covered under seller protection. I could be wrong though, as Ive never dealt with this situation. Perhaps somebody who has will chime in.

I wouldn't refund anything. You did everything correctly as far as I can tell, while it seems this person has done everything as shady as can be done. There are a lot of scams going on Ebay these days, especially with high end products, so I'd fight the Paypal case.

thanks Will but decided to let eBay handle.

so a few days after my last update, I contacted eBay CS using that live chat of theirs. after nearly an hour of waiting, I finally got a rep. this rep not only read slow but also took a few minutes to reply most times (most was maybe even 10!). The rep didn't really help since I basically explained the situation thoroughly. I then decided to escalate the case so eBay could decide it since I was leaving the next day. The rep agreed that this was "a good idea".

Anyway I return from my trip. Several days after I had the case escalated, eBay ruled in my favor! The buyer also sent some more messages before the ruling was decided (after I had escalated); don't know why since I told the buyer I would be on a trip (what an idiot). Anyway the buyer OPENS ANOTHER CASE the day after the first case was closed. The day I returned also happened to be the last day for me to respond to the case!

The case this time was that the item I sent was a fake dvd. Buyer claims the envelope had chinese on it. That's the jist of it. The rest is bull shit details like me not responding. I added two comments to the case. Afterwards the buyer sent two more messages.

So here's overview of whole ordeal (a tl;dr version of sorts):
1. I sell a used game on July 1x.
2. Tracking shows delivery on 2x.
3. Get message from buyer saying game is being sent back to me and to send to another address, a PO Box.
4. I check the tracking info. Apparently the place it was delivered matches the city (or town) and zip code of this PO Box address. There was an entry on the info that showed the game arrived at a post office (city/town and zip match the address I mailed to) but was then "forwarded".
5. Buyer sends messages and I reply basically stating if I get it back, I'll send to the address on PayPal only (which was the same address I sent to). Buyer says there's two addresses on his PayPal (home and the PO Box) and that only UPS goes to home, rest to PO Box.
6. More bitching. One message even says to please send it and not take a month in doing so.
7. I try my best to not sound pissed in messages and inform buyer I'll be going on a trip soon.
8. Buyer opens case on Aug 2 with reason being item never delivered.
9. I add two lengthy and detailed replies.
10. Few days later, I contact CS using their live chat and eventually.
escalate the case.
11. I go on a much needed trip.
12. Buyer sends two messages. Looking at the times, I was at the airport and later plane.
13. Next day, case was reviewed and closed, went in MY favor (PayPal funds no longer held). Based on the times, I was probably checking out of hotel and getting ready to actually get to the vaca destination.
14. Next day, buyer opens NEW case against me. Reason this time is that item is not as described. Buyer claims I sent a fake dvd instead of a real game. Based on the time, I was on vaca relaxing!
14. Return home around 4am due to 4 hour flight delay. At night, reply to the SECOND case opened.
15. Next day more messages. I reply. Now I''m not sure, but from what I have inferred this fake dvd is being sent back to the seller. Not sure if the buyer meant me or not.
16. Hours ago buyer decides to escalate and have eBay decides this case.

Now I guess I have to wait. Hopefully this case is ruled in my favor and funds are unfrozen. If by chance the buyer wins and I have to refund, I of course will fight like hell.

advice comments suggestions are welcomed (please make sure to have read the majority of what was posted)

I'm not sure there's much more than to sit and wait. We know he's a thief, you know he's a thief and he knows he's a thief, but the only one that counts is ebay.

I really hate to say it, but the best thing you can do is come to terms that someone may have ripped you off and that you'll get by without the $30. If ebay ends up ruling in your favor (which I hope), then you're good to go. If not, forget about it and move on. Oh, and post the guy's username so that other CAGs can avoid the sleazy little sneakthief.

Here's where you can share the username: http://www.cheapassgamer.com/forums/showthread.php?t=148600

This is why I have come to hate ebay. Not only are people out to scam you all the time now but ebay allows them to constantly keep fighting it. Eventually the scammer hopes that you don't respond in time thus giving them the auto judgement in their favor. I hate ebays crappy service and wish that yahoo auctions wouldn't have quit years and years ago so that ebay would still have some real competition. As for advice nothing short of closing the ebay user id will ever resolve this guy being an a$$ who is just trying to get the item for free.

So the first claim is that he, the buyer, never received the DVD? And the second claim is that he actually did receive the DVD, but it's fake/bootleg? Surely eBay will put 2 and 2 together and realize this guy is full of shit.

Wow, I hope you win. I'm going through a case myself with a seller that sent me a broken copy of Modern Warfare 2(It has a perfect circle scratch) and keeps trying to claim that it 'worked for him until the very day he sent it'. My problem is that he just won't escalate the case and keeps lying to me to try to scare me into to closing it. He thinks that I'm new to eBay or something, because I don't have too many feedback ratings. But I've done my homework, and I know he's trying to scam me. The people on eBay SUCK!

Although, they're not ALL bad. I bought a nice poster on the same day that I bought the game, and THAT seller actually sent me a second poster free of charge, with a nice little note attached. So don't give up on eBay just yet. Some people there are actually good people.

Install MW2 on your hard drive and/ or get the disk repaired at a video store and move on.

On eBay the buyer (thieving or otherwise) is always right no matter what. This holds from the lowest level dispute to a Visa chargeback. We sellers accept all risks when using the site.

My only two disputes (forced refunds with fee losses) are from a buyer in Canada and a buyer in Mexico. Canada is the worst, because there's no delivery confirmation. What a Canadian buyer says is all that PayPal takes into consideration.

Europeans and Australians have good integrity in my experience.

How do I install it on my hard drive if I don't have a working copy of the game? That's not sarcasm, and I'm sorry if it comes across that way, because I don't mean it like that. But, the fact that the game is scratched isn't the only problem I had, it was also supposed to come with a code for CoD classic, which turned out to have already been used. Also, another buyer came forward with negative feedback against the seller. This seller has only 35 feedback ratings, two of them are negative, but he had a perfect 100% before I bought the game. I'm not gonna just get over it, I already spent 45 dollars on this game, so why should I spend more to get it fixed?

Either way, let's not hijack this thread. Let's stay on topic and hope our OP can win his case!

You really only need to meet 3 requirements,

1. Shipped to confirmed Paypal address.
2. Delivery Confirmation
3. Be present to respond to Paypal when they ask about transaction

The rest is just whatever the seller feels like trying to screw you over with.

Also, could you post the buyer's eBay name either here on put it onto the blocked bidder list so we know to avoid this asshole.
