Call Microsoft and talk to them until they give you a new one.
Tell them that it's making funky noises and scratching your discs. If the person on the phone says they can't do anything and that they are the top person, hang up and call right back. You'll get a different person and hopefully a new manager that will approve your return. If they try to troubleshoot it, tell them you aren't putting any more of your discs in because it already ate a disc. If they tell you that it will be $59.99, tell them you can't afford it.
With me, they waived the fee (although I was only a month out of my warrenty) and only thing I had to pay for was shipping. It will take a month for you to get a new drive.
