Help Destroy a signed Jack Thompson book for charity! - video linked

You really have to stop buying into the JT brand of bullshit. How many people have been threatened with lawsuits by him? And of all those people, how many have actually been sued? That's just a tactic he uses to try to scare you, but everytime he uses it the effect lessens and lessens. You need to just relax. In fact, you don't even have to respond to him. Ask yourself what fraud is legally:

"Deception carried out for the purpose of achieving personal gain while causing injury to another party."

So, where was Thomson injured? How has his position weakened by giving you his autograph under the "It's for someone else" pretext as oppossed to, say, signing it at a book convention? Thompson is crazy, but isn't stupid. He knows anything he brings against you will be tossed out (which means he'd have to pay your legal fees), AND he'd have to fly to your state to go to court. Just sit back and let him scream all he wants.

I'm trying to think of someone who is flamboyant, loud, and obnoxious, but you can usually destroy in about 8 seconds.

There was a boss early on in FF8 that you fought on a train I think. If you drew it out he could hit very hard, but all you had to do was throw a phoenix down at him and he'd die instantly. You mean like that?

You also aren't achieving personal gain through any actions you may have taken, unless you're going to run with the newfound publicity and become an actor under the stage name of "Visc" ;)

To Visc, what does he mean by fraud? I don't understand how even fraud can be a legal case here.
 
Visc, my girlfriend is graduating from law school next month. I can ask her what she thinks...she'll be home in about a half hour. I'll have her make a short post in this thread. She can't give legal advice yet, but she might know something normal people won't..

I think what you're doing is downright hilarious..heh.
 
Okay, my girlfriend also said that there didn't appear to be any case of slander (as you have not written anything horrible in the ebay auction that would harm his reputation or character) or defamation of character, for basically the same reasons. She says that as long as you keep your cool, and don't start calling him names, then you should be fine - as the book is your property and you can do whatever you want with it.

She also assumes it's a scare tactic, to get you to pull the book down and lessen the negative publicity he's gonna get from this whole thing. I wouldn't worry - they seem to just be words to me.

Let the guy bitch all he wants. It's really funny and I think it's a great way to make a statement.
 
OK. After reading Jack Thompsons response. I think you should consider changing the auction.

You should allow for some kind of contact of the book with my testicles!

What an...oops...better not say anything or he might come after me next.
 
I'm going to keep you guys up to date as much as I can on this, but right now its payday and I have a check to pick up, and a sammich to eat, so I'll be back in an hour.
 
well, apparantly I got an update as I was typing that last one. A friend of mine from gamepolitics, who is a very good attorney in NY, has told me that he and a bunch of his ex-DA buddies agree Jack has no case. He told me I have 3 options:
1. Offer to sell the book at retail price and end the auction
2. Tell him to bug off and leave it up.
3. Ignore him completely and wait for a threatdown from him, then counter him.

If I choose options 2 or 3, my buddy offered to help me find a good probono lawyer in case a lawsuit is retaliated. When I hear more I'll put more up, but that check and sammich are calling me.
 
I'm all for burning written words that are useless.

We should cherish the classics and revolutionary writings...not fear mongering and opportunistic pieces by a florida lawyer.

Hope you stick with it. Be the man and go against the tide.

Before you overreact please understand this one point, JT’s asking you to have your lawyer contact him is a scare tactic used by lawyers on those unknowing to the legal process. You have no reason to contact him or to have someone contact him on your behalf.

Let him play whatever game he wants to play while your auction is running. If and only if you receive a certified letter or a summons of some sort do you actually have to even worry about getting a lawyer. Everything at this point is PR and spin at this point.

That being said, I hope you understood that this was a very real possibility from the beginning. As someone who has had been in a similar, albeit much less publicized event, you don’t have anything to worry about until you actually receive some documents from his office.

That also being said, can you summarize how you received the autograph if you haven’t done so already?

Finally, let this be a lesson that taking on a zealot is never an easy thing to do, otherwise they wouldn’t be a zealot.

Visc if you dont want the headache yourself and choose #1 I would gladly pay you fair price for the book and repeat your auction and deal with whatever legal ramifications may come.

I made a typo in part one, I was told to offer to sell the book to Thompson at retail price and end the auction.
 
I recently received a VERY positive email where I will be given any and all assistance I may need if it comes down to it by a very trustworthy person. I'm sticking this through to the end as best I can.

Did you actually think you'd do this without getting sued? Sure, he wont win, but you'll lose a lot of money going to court over this... I just figured you were finacially secure.

Thompson isn't going to sue. He'll threaten the hell out of you, maybe get local authorities a *tad* involved if at all possible, but he's about 70% bluff (it's not like he never sued *anyone*, but truthfully, this thread and the OP's charities are small potatoes).

Imagine if celebrities and politicians acted like Thompson, personally, pitifully, and tritely responding to every last little nugget of criticism that any Joe Schmoe leveled on them. "Entertainment Tonight" would be like fuckin' GameFaqs TV. "Tonight, Linsday Lohan tells her flamers: 'Oh noes you don't!'"

in a recent interview with a paper who spoke to him about a recent lawsuit filed against the florida bar, Thompson said this:

"I enjoy doing what I do and I think I've got a First Amendment right to annoy people and participate in the public square in the cultural war,"

So did he just supply me my own defense or what?
 
Its awesome you wont give in. You really should do what you are doing and keep it up until the end...if Jack really wants it he can bid on it himself :p
