Here's a tip: if you can't wait to play the game before your shipment comes, just buy it now at any store and KEEP the receipt. Open the game and play it. When your shipment arrived, take that unopened game and your receipt and return it. They all share the same barcode anyway if they are the same game.

So simple.. why didn't I think of that?

I already do that, although not over something so simple as having to wait an extra week. Generally I do it when I can't find a deal AT ALL, so I buy it somewhere with a generous return policy(target or walmart), then return it if I find a better deal later.

Worked out great with Rallisport 2 and Psi-ops. I got them close to release, but ended up paying $24.99 after the GGC because they dropped in price so quick.

I don't see how that's fraud. It's not like you're returning it at Walmart without a receipt.

It's mindfully abusing a return policy. You're right, the Wal-Mart thing is far, far worse, but this is just one step behind it.

I really don't see anything wrong with it. You are just returning the exact same game that you buy from them, same quality sealed intact product. They don't lose a penny at all, and all we earn is the time from waiting for a game to come. (I think this is even more right to do than the Target Raincheck thing or BestBuy Gamer Gift Card, in which they actually lose money or earn less money)

I've been doing that for years....

Its not fraud, you are returning the same game in the same condition as when you bought it.

PS. I also do this when I purchase a game and find it cheaper later on within the return period.

not even close to fraud..i don't know what you've been sniffing

what is with all the anti-piracy, anti-fraud people on this site? the smallest opportunity and they start jumping on everyone

Technically, it is fraud: the copy you're returning to them is not the same copy that they sold you. Especially if you get one of those places that has a really generous (like 90 day return) policy on games, for those you could've bought games like Breakdown and Beyond Good and Evil right when they came out, and then 2 months later when they drop down to $20 you could buy it and return it for $50. Morally it's up to the individual, but technically it is illegal.

Site is slow and freezes when you check out. I had to call to place an order.

(500 mark here.)

Damnit Fable needs to come back for 30.99, and the return thing definitely isn't fraud I would love to hear you make your case on it though.

Damn outpost.com, I ordered Skies of Arcadia on monday with 2nd day shipping and it still hasn't come yet. I called them and they said they got confused about my address.

The tracking site for my Fable order says it should arrive Monday. Only about a week after it released, so it is a great deal if it actually makes it here tommorrow.

Riiiight.....

I think you're missing the point, when we return the game, we are not profiting anything and the store is not losing anything. We get the money that we paid for back and they get the game they sold us back in the same exact condtion. Man, there are too many paranoid goody two shoes people in this site.

fraud definition – fraud is defined as a deception deliberately practiced to secure unfair or unlawful gain.

playing a game for a few days until your shipment arrives is unfair gain and therefore is fraud, end of topic

The store can lose out. Let's say you buy BG&E for $50 when it is first released. The store paid $30 to the game distributor and stands to make a $20 profit from the sale. You return the item three months later (Toy's R Us has a 90 day return window) when the MSRP falls to $20. The store can resell the item, but would now be doing so at a $10 loss. By taking advantage of these liberal return policies, you cheat the store out of an opportunity to sell the item at the higher price.

Example 2: You buy a newly released game at EBGames that you plan on "returning" in a week or so when your online order comes in. If anticipation for the game is strong enough, odds are this store will sell out of their initial shipment quickly. If someone else comes into EBGames during the following week looking to buy the sold out game you're "holding", EBGames loses out on the sale to another competitor.

So, while your actions may be perfectly legal, they aren't without consequences to the store.

Toys R Us return policy is for 45 days, not 90

And about your scenario, anonymouswhoami. Regardless if you bought the game or not, they will lose money on that refund unless the game was selling out. But assuming such a price drop occurs that quickly, a sell out isn't gonna happen. The store will lose money on that unit even if you didn't do the return scheme

My aunt actually did a price-drop guarantee at Target. If the prodcut drop in price before the return-period, you can actually get the difference back. For Target is 3 months, so if they drop their price within that frame, you can get your money back anyway. So they expected someone to do this.

Toys R Us's return policy has to be more than 45 or 90 days. I bought several GTA3's when they first came out at TRU and played one and tried to sell the others on eBay. I sold them all for profit except 1, so I just kept it on my shelf because I was too lazy to take it back. Then right before GTA:Vice City came out (1 year later) I took it (GTA3) back but only got in store credit instead of cash because I didn't have my receipt anymore. I got off my butt and took it back because I knew once Vice City came out GTA3 would drop in price and I wouldn't get my full money back.

Illegal or not, unethical or not. I usually buy GTA off the internet for about $40+shipping (like the outpost deal $35 +shipping +tax = $44 something) but I know I won't get the game to my house on release day, so on release day I run and buy it at TRU for $49.99 + tax = $54.11 and I get the game on release day. Then when the other one comes in the mail a few days later I take it back to TRU and once I get refunded I end up with having got the game on release day for about $10 less.

I got Fable ($30.99) in the mail today. FYI, I was number 400 something on the preorder list when I ordered on Sept 6. Not too bad a wait.

mdenison, the official TRU electronics policy is 45 day return with a receipt. For electronics(games, etc) if you don't have a receipt TRU isn't supposed to take it back. They do make occassional exceptions and will give a gift card without a receipt.

And buying a game at TRU, playing it, then getting one a week later from another store at a cheaper price and returning it to TRU is not illegal. It may be unethical, but it falls under TRUs policy.

And the whole WM return policy thing is unethical also and can be considered fraud, but its not illegal either. Returning a game to WM that you bought elsewhere is just taking advantage of WMs very relaxed return policy. Eventually WM may be forced to change the policy because of people like this, but for now its all part of their policy and they don't know where you really got the game from.

They even changed the status of my order to "Backorder".
