The lack of storage space is the other big problem. Can't assume people have SD cards, and Nintendo seems pretty anti-HD at this time, despite their comments prior to launch.
They could just say

Well I think the other way they could account for that is the Halo way...sorta. Halo has playlists specifically for people who have downloaded the map packs before they become free. This separates the haves from the have nots.
Nintendo could potentially create a matchmaking system where it reads if a player has DLC and thus matches them against other players with DLC. This doesn't mean that they could only use DLC players or DLC levels. I'm saying that if the game could detect what each player had, and matched them up, so you say could have a match between Mario and oh IDK Dante from DMC if he were a DLC character.
Of course this is Nintendo we're talking about, and I doubt that type of system would ever
