Man, I didn't know Earthbound was full of music references either. I only just found out Michael Jackson worked on Sonic 3's music (see spoiler). I mean I imagine the Runaway 5 is the culprit here - I'll have to research all of this.

[Edit: Embedding is disabled, and since I still can't hotlink to a Youtube video without CAG's code immediately turning it into a movie, there's little else I can do with the above. Sorry.]

I think the bigger thing to consider is if NoA wanted the game out "only with changes," then I can only imagine the clusterfuck that would have been. Probably ripping out music in favor of some trashy synth techno bullshit, which would be removing a part of the entire game's soul. In that regard, I have to applaud NoJ for refusing to allow that to happen.

There's a side note of fuck the RIAA here, but that should more or less be understood in every post on the internets.

I guess it's time to consider this the final nail in the coffin. I've known the hope was slim to none for a while now, but this really seems to hit it home into "completely dead" territory.

A real fucking shame. Whoever is running the show needs to be deposed, and someone with a damn clue needs to be installed, because this is just ridiculous.

foltzie: NeoGaf already got the Commodore 64 references. Check back a page in this thread.
Tons of music refs in Earthbound. A lot of the tracks have riffs from Beatles songs, and some from David Bowie too (MIDI of course). I'm not giving up hope yet. I can't. Just like my hope of seeing Secret of Evermore.
I only welcome more systems if it means we get more than 1 VC game each week. Otherwise, it will just water down the pool and take even longer for some of the much-anticipated games to appear.
Sounds about right.
In that regard, I have to applaud NoJ for refusing to allow that to happen.
Yes, if that was in fact the context, then bully to NoJ. It could have also been a reluctance to allocate resources, but I prefer to think of it as NoJ putting the foot down on behalf of its creators and the work itself. I'm glad they did. EB is one of the rare titles that has everything just so, and if they would've fucked that up and released it on the VC, we would have been secretly disappointed, maybe even resentful, as we ponied up and then played through. At least longtime fans would have, and thanks to starmen.net there were a lot of them queued up to buy this one.

How can NoA tell NoJ what to do? Can't they just say "fucking do it!"

NoA's (lawyers it would seem) have significant sway on what does and what does not get approved. Having to have the blessing of legal is not uncommon in the corporate world. Also, Japanese culture heavily favors consensus based management. It is unlikely that NoJ would demand release of any title.

As odd as it may seem Nintendo isnt in any rush with Earthbound even in Japan. Despite being a classic in the Japan version of SSBB it hasnt hit their VC either.
How can NoA tell NoJ what to do? Can't they just say "fucking do it!"
Huh? NoA said "we can't release it without changes," and NoJ said "fuck that." Doesn't sound like NoA telling NoJ what to do at all, unless I'm misunderstanding.

This has something to do with the way copyrights/trademarks work if I'm not mistaken, which is the basic root of this problem if Starmen.net is to be believed, pointing toward trouble with the RIAA and referenced famous music tracks.

NoA is fast becoming the lame duck of the entire enterprise, with their reluctance to release certain games, lagging to get a ClubNintendo branch running, and seemingly being so complacent about their system in light of the success its been. Wanting to change music out in a cult classic game sounds legitimate play for them, simply because they've always been antsy about getting bitten in the ass down the road for silly reasons (censoring games, changing sound effects, etc etc).

They really DO hate this series more than Metroid. Holy damn.

Is there even a reason to pay attention to the weekly releases anymore? Except for a few games that would take some work on nintendo's part (starfox, yoshi's island, majora's mask, etc) I can't think of anything worthwhile to look forward to. I guess it's a good thing that the game wont be tweaked, but Ive been waiting on this to come out since the virtual console was announced! I'm kinda sad now. I was really looking forward to buying this game (again) and would gladly gift it to all of my friends. What a missed opportunity...
Is there even a reason to pay attention to the weekly releases anymore?
There's definitely a good few games that could be released, on both the VC and WW fronts. But that doesn't change the fact that most of the press releases fail to instill any excitement.

It really has become a completely missed opportunity in some respects.

Yeah there have been a few wiiware titles and many great 1st party games that I've bought in the past and am loving, but looking forward it doesn't look like anything good is headed our way. This weekly trend of seeing 1 crappy VC game a week has me concerned. I have a bunch of wii points on my account(thanks to CAG) and I dont know if I'll ever use them all up! :0

I took a listen to those samples too. I never noticed any of those! Thanks for reminding me of how much the Earthbound soundtrack rocks.

I dont know what the exact issue is (because Nintendo hasnt officially said anything), but it just highlights that companies can sometimes place too much faith in their legal departments, assuming legal approval is the holdup. Everything in Earthbound should be covered on the basis of satire, as the game and series is seemingly a send up of western culture.

Commodore 64 was awesome. My dad got one at US release many moons ago. I remember when I was just a few years old playing Quasimodo, Another World and other cool games like the Bad Dudes (!!!) C64. Yeah... good times. Hope the games are cheap and might just buy one to show my dad when he comes over. Dude.

Get Life Force if you haven't already. I just dug up my old copy and my NES top loader and hunkered down in front of my CRT screen in the basement.

Two words: Begins with 'K' and ends with 'e' and in the middle, there's "_onami cod_"

NOA needs to grow a pair.

To be honest, I had only played Earthbound recently and I don't get the splooging that nearly everyone makes over the game. Maybe it is mostly nostalgia speaking from their minds, or there is some charm that I missed, but I'm not sure if I would classify it as the "best rpg ever". However as Strell has previously mentioned, NOA's treatment of it's fan base is ludicrous; most developers would kill to have this kind of following.

It is a amazing that a game is okay to be released in 1995 is not okay for release in 2007 and beyond. If songs appear to be an issue, I would argue that any of the examples provided could be classified as fair use. I haven't listened to any of the sounds clips listed above, but I don't really recall hearing any familiar tunes back when I played through the game.

The internet hadnt begun to reach its height in 1995 and as such the RIAA wasn't really paying attention to anything more than bootleg CD manufacturers.

Your other point is valid, the game parodies western culture; however, that fact may not prevent a lawsuit.

It is a bit humorous, I think we have the Mother series to thank for the existence of the quirky Mario RPG titles.

One final note: All of this silliness is occurring with a president at the helm of Nintendo that has a soft spot for the Mother series. Iwata started at Nintendo on those games and was one of the creators of Smash Bros. You couldnt find a more sympathetic ear at Nintendo.
Ran across a page that talks about music sampling in Earthbound: http://earthboundcentral.com/2009/02/earthbound-music-similarities/

I'll have to listen through 'em later.
As Mato said later, he only intended that article to highlight some trivia. He posted his research into any potential legal issues here, along with his opinion on the situation (Keep in mind, Tomato is not an IP lawyer):

(note: this song [Hippie battle theme] is in EarthBound Zero/MOTHER 1 too. It was also planned to be used in Smash Bros. Brawl but was cut out of all versions of the game.)
I found this one interesting, as I knew that it was in the first game, but I didn't know about the latter part.

I'm rather surprised that the SNES was capable of samples... I always thought the SNES (like the NES) was restricted to the consoles MIDI instruments.

I haven't played Earthbound, but Mother 3 (fan translation), was indeed all it was cracked up to be. I definitely would like to play Earthbound now and would buy the VC version if it were to be made available, but that looks like it won't happen. So... I'm going hope for a fan translation of Mother 1 & 2. I'd rather play the Japanese games translated. The team that did Mother 3 hinted to that effect. I realize it will be quite a bit of a wait. Am I mistaken, or is not Earthbound equivalent to one of those 2 games? Which one?

Mother 2 = Earthbound

This week, Europe got 2 VC games, Wolf of the Battlefield: MERCS - SEGA Genesis/800 Points, and Winter Games - Commodore 64/500 Points.
Where are the Star Wars games from the snes and the 64?
They're being held on Kessel by Scorpion Vader.
Where are the Star Wars games from the snes and the 64?
Gotta wait on the remastered George Lucas search for more money editions.

If its what everyone says it is, that's a very crappy surprise. Would be nice if Nintendo was just saying all that about Earthbound to throw us off its trail, and then tehy could come back and say "Surprise, we made you think we would never relase it but we were just being dicks, here's the game"

I'm gonna guess they are gonna update the press release at noon (EST)..maybe? Is anyone home right now they could check in 15 minutes?

I'm dying to be disappointed as always.

I'm here , if someone else doesn't get to it first.

Yep Commadore 64. Three games ; International Karate , Pitstop 2 , The Last Ninja , plus Onslaught for WiiWare.

I had The Last Ninja on my parent's old, old, Apple IIe. It was hard as shit. I might get it again and see if it's more playable with a decent controller.

I just don't understand. I really wanna be the head of that department. I get to pick my ass all week, google "RETRO GAYMEZ" and put them on the Shop Channel .....and get paid big dollas

I was thinking the same thing Blue , I watched the trailer on the Nintendo Channel and it seemed really impressive for a downloadable shooter.

Also watched the Commodore 64 launch video and was kinda interested in checking some of the games out. I'd never actually seen or heard of any C64 games , but they don't look like they'd be any worse than the typical NES game.

onslaught is really terrible. :(

wow, i've never played a commodore 64 game and youtubing videos of those games isn't really pushing me to do so.

If they NEED to have C64 games..then they should be like 300 points. $5 for some NES games are pushing it...

Soon Atari 2600 games will be up for $6 each!! :whee:

500 points?

fuckin' VC.

I YouTube'd International Karate. I think I'd rather be kicked in the dick by an NFL Punter than play that game, let alone pay $5 for the privilege.
Onslaught actually looks really impressive for a WiiWare title.
It is really impressive. It's not your typical FPS, but it is really good. Everything is done really well.

Hopefully this will spur others to make some more FPS games for wiiware. I'd love to see some classics return like Blood.

Someone gift this man Internation Karate and setup for a round of Roshambo and see which is worse.
Has anyone here, ever, used an emulator to play C64 games?
No, but I do have fond memories of something like

LOAD * ,8,1

or something to start up a game on a friend's C64.

Golly, I hope Nintendo included the command line with these games!!

I would pay 500 points for M.U.L.E. and Impossible Mission.... maybe Space Taxi, but beyond that I don't think there are any other C64 games I am interested in.
